Welcome to PatrolMyBlock.com (“PatrolMyBlock”, “we”, or “us”). By subscribing to or purchasing our patrol services (the “Services”), you agree to be bound by these Terms and Conditions (“Terms”).  The term “you,” as used in this these Terms, means any person or entity who uses the Services.  Please read these Terms and our Privacy Policy carefully before you start to use the Services.  If you do not agree to these Terms or our Privacy Policy, please refrain from using our Services.

Service Description

PatrolMyBlock provides a patrolling service in designated local areas, wherein a patrol officer conducts regular patrols of specified neighborhoods for a specified duration (6-8 hours or as otherwise determined by PatrolMyBlock).  The Service aims to enhance neighborhood visibility and provide a deterrent against criminal activity.  However, PatrolMyBlock does not guarantee crime prevention or immediate response to emergencies.  The Services are offered and available to homeowners in the designated local areas who are 18 years of age or older. By using the Services, you represent and warrant that you meet the foregoing eligibility requirements.

No Guarantees of Security

While the presence of a patrol officer may serve as a deterrent, PatrolMyBlock does not guarantee the prevention of any criminal activity, including but not limited to break-ins, vandalism, or theft.

 

BY PURCHASING OR STARTING TO USE OUR SERVICE, YOU ACKNOWLEDGE AND AGREE THAT THE SERVICES ARE PROVIDED FOR YOUR CONVENIENCE, “AS IS” AND “AS AVAILABLE”, AND PATROLMYBLOCK EXPRESSLY DISCLAIM ANY WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT

Limitation of Liability

To the fullest extent permitted by law:

 

PatrolMyBlock, its owners (including, but not limited to, Adam Sin Golda), managers, members, employees, contractors, and agents are not liable for any damages, losses, or injuries relating to the Services or your use thereof, including but not limited to:

 

  1. Property damage, theft, or loss;

  2. Bodily harm or injury resulting from criminal activity or otherwise; and

  3. Any indirect, incidental, punitive, or consequential damages arising from the use of our Services.

 

In no event shall PatrolMyBlock’s liability for damages exceed the fees paid by you to PatrolMyBlock for the Services in the three (3) months under these Terms.

 

You agree that your participation in this service is voluntary and at your own risk.  Under no circumstances shall PatrolMyBlock or its owners be held liable for any claims or lawsuits related to property damage, crime, or personal harm that occurs while using our services.

 

You assume total responsibility for your use of the Services.  Your only remedy against PatrolMyBlock for use of the Service is to stop using the Service.

Customer Responsibilities

You are responsible for ensuring that your property is adequately secured, including but not limited to locking doors, installing alarms, or other security measures.​

 

PatrolMyBlock is not an emergency response service and will not contact emergency services on your behalf; you must contact local law enforcement or emergency services in case of an emergency.  PatrolMyBlock will not be liable for any delays in receiving help from emergency services.

No Guarantee of Continuous Service

We reserve the right to withdraw or amend the Service in our sole discretion without notice.  More specifically, PatrolMyBlock reserves the right to modify patrol schedules, routes, designated neighborhoods, or durations as necessary. While we aim to provide regular patrols, however, PatrolMyBlock is not responsible or liable for any delays or failures in performance from any cause beyond their control, including, but not limited to acts of God, changes to law or regulations, embargoes, war, terrorist acts, pandemics (including the spread of variants), issues of national security, acts or omissions of third-party technology providers, riots, fires, earthquakes, floods, power blackouts, strikes, supply chain shortages of equipment or supplies, financial institution crisis, weather conditions or acts of hackers, internet service providers or any other third party acts or omissions.

Payment and Subscription

By subscribing to or purchasing our Services, you agree to the fees and payment schedule outlined on our website.

 

Failure to pay for Services may result in suspension or termination of service.

Indemnification

You agree to indemnify, defend, and hold harmless PatrolMyBlock, its owners (including, but not limited to, Adam Sin Golda), managers, members, employees, contractors, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising out of or in connection with:

 

  1. Your use of our Services;

  2. Your breach of these Terms;

  3. Your negligence or willful misconduct; and

  4. Any third-party claims related to your property.

 Intellectual Property 

All intellectual property on our website is owned or licensed by PatrolMyBlock. All rights to the intellectual property on the website are reserved. Any use of the trademarks or other intellectual property on the website or otherwise used by PatrolMyBlock without our express written authorization is strictly prohibited.

 

If you provide any suggestions, ideas, enhancement requests, feedback, recommendations or other information relating to the subject matter hereunder, you hereby assigns to PatrolMyBlock all right, title and interest (including intellectual property rights) with respect to or resulting from any of the foregoing.

No Legal or Emergency Services

PATROLMYBLOCK IS NOT A SUBSTITUTE FOR LAW ENFORCEMENT, EMERGENCY SERVICES, OR LEGAL PROTECTION. FOR IMMEDIATE ASSISTANCE IN CASE OF A CRIME, FIRE, OR MEDICAL EMERGENCY, CONTACT YOUR LOCAL LAW ENFORCEMENT AGENCY OR DIAL 911.

Applicable Law & Disputes

These Terms shall be governed by and construed according to the laws of New York without reference to its conflicts of law rules. The interpretation of this Agreement shall not be construed against the drafter.

 

All disputes and claims arising out of or relating to this Agreement will be submitted first to mediation and, if unsuccessful, to mandatory binding arbitration in New York, New York or another agreed-upon location, before a single arbitrator and under the American Arbitration Association Commercial Arbitration Rules and Mediation Procedures, except as they are modified by this Agreement.  You agree that the foregoing shall be the exclusive provider for any mediations or arbitrations.  The arbitration proceedings shall be conducted in English.  All information regarding any arbitration proceedings, including any mediation settlement or arbitration award, will constitute confidential information.
